A Los Angeles County Superior Court judge Friday ordered an Eagle Rock dispensary to stop selling medical marijuana in a decision city prosecutors believe is the first to conclude that state law does not allow collectives to sell the drug.
Judge James C. Chalfant’s preliminary injunction applies only to Hemp Factory V, a small outlet on Colorado Boulevard near the Glendale border, but would have a dramatic impact on how medical marijuana is distributed if a higher court upholds it. The decision came in the pretrial phase of the city’s lawsuit against the dispensary.

LOS ANGELES — The City Council approved an ordinance on Tuesday that would shutter the majority of the nearly 1,000 medical marijuana dispensaries in Los Angeles and make the use of marijuana in the remaining outlets illegal.

The vote is a major setback for backers of medical marijuana and a victory for community groups that have long complained about the proliferation of the dispensaries near residential neighborhoods, schools and parks. Los Angeles has more of the outlets than any other city in the dozen or so states that allow the use of marijuana for medical purposes.

FRESNO, Calif. — Fresno officials say one city medical marijuana dispensary is continuing to sell pot despite a Fresno County judge’s ruling that such sales are not allowed.

Judge Donald Franson on Thursday made permanent an earlier decision to ban the city’s nine pot shops from operating.

Deputy city attorney Michael Flores says five dispensaries reached a settlement with the city and closed, and Franson signed orders to shut down the other four.

But Flores says one shop, Medmar Clinic, is still operating, and that its owner is set to face contempt of court charges. Medmar did not immediately return a call.

Franson’s ruling upheld a 2006 city zoning ordinance that requires all city businesses to meet state and federal laws. Federal laws ban marijuana use.
