A state appellate court Wednesday upheld Riverside’s citywide ban of medical marijuana dispensaries.

The court ruled that nothing in the state’s1996 Compassionate Use Act (Prop. 215) or the state Legislature’s Medical Marijuana Program, which outlines usage, pre-empts cities from banning the facilities.

“The CUA and the MMP do not provide individuals with inalienable rights to establish, operate or use (medical marijuana dispensaries). The state statutes do not preclude local governments from regulating MMD’s through zoning ordinances,” Associate Justice Carol Codrington wrote.

A landlord in San Diego can evict a medical marijuana dispensary because under city zoning laws, pot dispensaries are not legal anywhere in the city, a Superior Court judge has ruled.
